Executive Secretary Lucas Bersamin has refuted allegations that the recent restructuring of the National Security Council (NSC) by President Ferdinand R. Marcos Jr. is a step towards imposing martial law. These claims surfaced after former presidential spokesperson Harry Roque suggested that the President might be considering military rule, particularly following the exclusion of the Vice President and former Philippine presidents from the NSC. Bersamin labeled such thoughts as ‘malicious,’ emphasizing that the Constitution clearly outlines the conditions under which martial law can be declared, and he believes this is not currently on the President’s agenda. Instead, Bersamin highlighted that Marcos is focused on the nation’s economic growth, public health, welfare, and his legacy projects. On December 30, 2024, Marcos issued Executive Order 81 to reorganize the NSC, aiming to strengthen its role in safeguarding national security and sovereignty, and to adapt to both domestic and international challenges. Bersamin also responded to criticisms from former chief presidential legal counsel Salvador Panelo, who described the removal of Vice President Sara Duterte from the NSC as a politically motivated decision. Bersamin argued that Panelo lacks the moral authority to critique Marcos’ decision, pointing out Panelo’s similar stance during the term of former President Rodrigo Duterte. He further explained that the NSC serves as an advisory body to the President, who has the right and responsibility to select trusted advisors. Bersamin concluded by stating that the Vice President’s membership in the NSC is ‘irrelevant’ to its function.
